Who you are dealing with
These terms are between you and Bright Tembeng, an individual doing business as TOP Agency in Gatineau, Quebec, Canada. TOP Agency is not incorporated. Email: [email protected].
Business customers only
TOP Agency serves businesses and organizations only. By ordering, you confirm that you are buying for your business and not for personal, family or household use.
Scope of the starter website
The $100 CAD starter offer is a responsive, one-page website with up to five content sections, basic navigation and contact links, basic search metadata, free-address deployment and two consolidated revision rounds. You provide accurate text, business details, brand assets and appropriately licensed images.
Add-ons and external charges
The pricing page defines each add-on, its limits and exclusions. Paid domains, external subscriptions, transaction fees, licensed assets, premium hosting and features outside published scopes are additional and require your separate authorization. Prices are in Canadian dollars. TOP Agency is not registered for GST/QST and, as a small supplier, does not charge these taxes. If that changes, taxes will appear at checkout before you pay.
Ordering and payment
You choose the services and see the full price before paying. A 50% deposit, paid through Square, starts the project. The remaining 50% is due after you approve the final preview and before the website goes live. Square processes card payments on its own pages; we never receive your full card number. Optional maintenance at $29/month starts only if you authorize it separately after launch.
Design brief and delivery
You complete the design brief after your deposit is confirmed. Work begins when we start designing from your completed brief. We confirm a timeline after reviewing it; the pricing page does not guarantee a fixed turnaround. Timely answers and usable materials from you keep the project on schedule.
Revisions
A revision round is one consolidated list of reasonable changes within the agreed scope. Two rounds are included. New functionality, a completely new direction or extra pages are quoted separately.
Cancelling and refunds
You can cancel your project at any time by writing to us. If you cancel before work begins, we refund your deposit in full. If you cancel after work begins, we keep only the value of the work actually done, in proportion to the agreed price, plus any third-party costs you approved in advance, and refund the rest of what you paid. If we have to end the project ourselves, we refund everything you paid for work you have not received. Refunds go back to the card you used, through Square, within 15 days of the cancellation. Nothing in these terms limits rights you have under the Civil Code of Québec, the Consumer Protection Act or any other law that applies to you.
Launch and ownership
We publish your website only after you approve the preview and the remaining balance is paid. Your logos, text, photos and other materials stay yours, and you confirm you have the right to use them. Once the full price is paid, you own the final website content and design created for you and may use, change and host it as you wish. Fonts, licensed images and code libraries stay under their own licences. We show your website in our portfolio only with your permission. Domains and service accounts should be in your name. TOP Agency does not guarantee the availability of third-party hosting or services.
Maintenance
Optional care at $29 CAD/month includes routine uptime checks, technical troubleshooting within the original scope and one minor content change of up to 20 minutes monthly. It excludes new designs, extra pages, new features, provider fees and guaranteed emergency response. You can cancel at any time by writing to us; no further monthly charge follows the month already paid.
Applicable law
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. They are available in French and English.
